Is it possible for my ex-wife to come and reconcile on a visitor visa and stay in the US?

We have three children together who are US passport holders living in Japan at the moment. They are all planning to come here in August at which time my ex-wife and I are planning to re-marry. What hoops will we have to go through so she doesn’t have to leave me and the kids to go back to Japan. Or can she stay here and wait for new visa status??? Thanks

    once you are married she shouldn’t have to leave the us. marriage to you if you are a us citizen should make it legal for her to stay

    K-1 is about right. If she comes on a tourist visa, marries you and tries to stay it’s immigration fraud. Deportation and banned from US for 10 years to life. Do it legally. It may take a few months but it’s better that way.

    When you and your wife had the children, what was her status in the US? What is your status? A visitor is not legally allowed to enter the US with the intention of adjusting their status. If she enters on the visitor visa and you do decide to stay together adjusting her status is the easiest thing to do, if you are a USC. If not you will have to reapply for her and she will have to wait in Japan for the visa.

    You need to apply for a fiancee (K-1) visa for her before she comes to America. You will have to prove you met within the last 2 years just like any other applicant. There is no way she will be able to adjust status and stay if she comes to visit.
